Washington has a variety of laws regulating the sale, possession, and use of firearms and ammunition. These laws are designed to enhance public safety and reduce gun violence while respecting the rights of gun owners.
Background
Washington is a shall-issue state for concealed carry permits. This means that the state must issue a concealed carry permit to any applicant who meets the basic requirements set by law. The state also has a number of specific regulations regarding the purchase, possession, and use of firearms.
Purchase and Possession
In Washington, individuals must be at least 21 years old to purchase a handgun or a semi-automatic rifle. For other types of firearms, the minimum age is 18. All firearm purchases from licensed dealers require a background check, which is conducted through the National Instant Criminal Background Check System (NICS).
Private sales of firearms also require a background check, which must be conducted through a licensed dealer. This requirement was established by Initiative 594, which was approved by voters in 2014.
Concealed Carry
To carry a concealed pistol in Washington, individuals must obtain a concealed pistol license (CPL). Applicants must be at least 21 years old, a U.S. citizen or permanent resident, and must not have any disqualifying criminal convictions or mental health conditions. The application process includes fingerprinting and a background check.
Washington does not require a permit to openly carry a firearm, but there are restrictions on carrying firearms in certain locations, such as schools, courthouses, and public buildings.
Assault Weapons
Washington has specific regulations regarding assault weapons. The state defines assault weapons as semi-automatic rifles with certain features, such as a detachable magazine and a pistol grip. The sale and transfer of assault weapons are subject to additional background checks and waiting periods.
Safe Storage
Washington law requires gun owners to securely store their firearms to prevent unauthorized access, particularly by minors. Failure to do so can result in criminal charges if a minor gains access to the firearm and causes harm.
Red Flag Laws
Washington has a red flag law, also known as an Extreme Risk Protection Order (ERPO). This law allows family members, household members, and law enforcement officers to petition a court to temporarily remove firearms from individuals who are deemed to be a danger to themselves or others.
