The Mattoon Burger King was established in 1952 by the Hoots family. The restaurant quickly became a local favorite, known for its burgers, fries, and milkshakes. In 1968, the national Burger King chain, which was founded in 1954, attempted to open a franchise in Mattoon. This led to a legal battle over the use of the "Burger King" name.
Legal Dispute[edit]
The Hoots family filed a lawsuit against the national Burger King chain, claiming trademark infringement. The case, known as Burger King of Florida, Inc. v. Hoots, was decided in favor of the Mattoon Burger King. The court ruled that the national chain could not use the "Burger King" name within a 20-mile radius of the Mattoon restaurant. This decision allowed the Mattoon Burger King to continue operating under its original name.
