Immigration Judge

An Immigration Judge (pronunciation: /ɪmɪˈɡreɪʃən dʒʌdʒ/) is a legal professional who presides over immigration court proceedings. They are responsible for making decisions on immigration-related matters, such as deportation, asylum, and naturalization.

Etymology

The term "Immigration Judge" is derived from the English words "immigration", which refers to the process of individuals moving to a country with the intention of residing there permanently, and "judge", a public official appointed to decide cases in a court of law.

Role and Responsibilities

Immigration Judges are appointed by the Attorney General and serve under the Executive Office for Immigration Review (EOIR). Their primary role is to conduct formal court proceedings, hear and evaluate evidence, make legal determinations, and decide whether foreign nationals have a legal basis to remain in the country.

Immigration Judges have the authority to grant various forms of relief, including asylum, cancellation of removal, and certain waivers of inadmissibility. They also have the power to order the removal of individuals who are found to be in violation of immigration laws.
