Health Court

Health court (/ˈhɛlθ kɔːrt/), also known as medical court, is a specialized court system proposed to handle medical malpractice lawsuits. The concept of health court originated in the United States as a potential solution to the perceived crisis in medical malpractice litigation.

Etymology

The term "health court" is a combination of the words "health", derived from the Old English hǣlth meaning "wholeness, a being whole, sound or well," and "court", from the Old French court, meaning "a short space, duration, a suit at law."

Concept

The concept of a health court is based on the idea of a specialized court system that would handle medical malpractice lawsuits. These courts would be presided over by judges who are specially trained in medical matters, rather than by juries. The goal of health courts is to provide more consistent and fair compensation to patients who have been harmed by medical errors, while also reducing the cost and complexity of malpractice litigation.

Related Terms

  • Medical malpractice: A legal cause of action that occurs when a medical or health care professional deviates from standards in his or her profession, thereby causing injury to a patient.
  • Tort reform: A proposed change in the civil justice system that aims to reduce the ability of victims to bring tort litigation or to reduce damages they can receive.
  • Specialized court: A court with a narrow subject matter jurisdiction, often involving specific types of cases or disputes.

Criticisms

Critics of health courts argue that they may limit patients' rights and that they may not effectively deter medical errors. Some also argue that the cost of establishing and maintaining such courts could be prohibitive.
