Trade name, also known as a trading name or a business name, is the name which a business trades under for commercial purposes, although its registered, legal name, used for contracts and other formal situations, may be another.

Overview[edit]

A trade name is used in the realm of business to indicate the name under which the business is conducted and presented to the world. It is not the legal name of the person or entity who actually owns the business and is responsible for it. The trade name is simply the name that the public sees, as opposed to the legal name of the business.

Legal considerations[edit]

In many jurisdictions, trade names must be registered with a government body, but this is not always the case. In some jurisdictions, trade names are not considered legal entities, and are treated as a branding exercise rather than a legally binding contract.

Use in healthcare[edit]

In the healthcare industry, a trade name may also be called a proprietary name. It is the name given by a manufacturer to a particular product, especially a drug, for the purposes of branding and marketing. The trade name is different from the drug's generic name, which is determined by its active ingredients.
